You have read and agree to the Visual 911+ App, Disaster ID App and Disaster ID +3 App Terms of Use and Privacy Policy.

YOUR USE OF THE INCIDENT REPORTING AND SMART PHONE APPLICATIONS (“Visual 911+ APP”, “Disaster ID” APP, and “Disaster ID+3 APP”) IS PROVIDED BY SOUTHWEST SYNERGETIC SOLUTIONS, INC. (“COMPANY”) AND IS AT YOUR SOLE RISK. LOCATION DATA, CRIME DATA, INCIDENT DATA, AND ANY OTHER INFORMATION OR DATA WITHIN THIS APPLICATION MAY NOT BE ACCURATE. VISUAL 911+ APP, DISASTER ID APP AND DISASTER ID+3 APP ARE PROVIDED “AS IS, WHERE IS”, AND COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, OR FOR FAILURE OF PERFORMANCE, IN WHOLE OR IN PART. COMPANY DOES NOT WARRANT THAT THE APPLICATION WILL BE FREE FROM DEFECTS OR ERRORS. ANY RELIANCE YOU PLACE ON SUCH INFORMATION IS THEREFORE STRICTLY AT YOUR OWN RISK. BY DOWNLOADING THIS APPLICATION YOU EXPRESSLY AGREE TO HOLD COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, MEMBERS, PARTNERS, SHAREHOLDERS, AFFILIATES AND SUBSIDIARIES HARMLESS FROM ANY LOSS, HARM, INJURY, OR DAMAGE WHATSOEVER ARISING FROM OR OUT OF YOUR USE OF THE VISUAL 911+ APP, DISASTER ID APP AND DISASTER ID+3 APP.

Always dial 911 in the event of an emergency. Always make sure you are in a safe place before reporting an incident when using the Visual 911+ App, Disaster ID App and/or Disaster ID+3 App. Sending incident tips while driving a vehicle is strictly prohibited. You are also subject to state/federal laws and regulations with regards to incident reporting and use of these applications.

Every situation is unique. Do what is necessary to protect yourself and others. The Visual 911+ App, Disaster ID App, and Disaster ID+3 App are tools used to increase awareness and provide a layer of safety. The Visual 911+ App, Disaster ID App, and Disaster ID+3 App are not and should not be the only tools used to increase safety and awareness. You should consult with your local law enforcement officials on how to increase your level of personal safety.

The Visual 911+ App, and Disaster ID App are offered for free to its end-users. However, the Company and its officers, directors, employees, agents, representatives, members, partners, shareholders, affiliates and subsidiaries, or anyone on its behalf shall have no liability nor responsibility to any person or entity with respect to any part of the applications and service including but not limited to downloading, use, crime reporting, connectivity, distress messaging, and expectations of this application, and they shall not be liable to you or to any third party, for any reason whatsoever, as result of use of the Visual 911+ App, Disaster ID App, and/or Disaster ID+3 App. You hereby irrevocably release all of the above from any liability of any kind, for any consequence arising from use of the Visual 911+ App, Disaster ID App, and/or Disaster ID+3 App including any loss, direct or indirect, financial or non-financial.

Due to the nature of the Internet and mobile SMS delivery networks, Visual 911+ App, Disaster ID App, Disaster ID App+3 and the Company do not guarantee security or timely delivery or reception of any submitted information including incident reports, distress messages, emergency notifications, and all other submitted and retrieved data. Neither the Company nor its officers, directors, employees, agents, representatives, members, partners, shareholders, affiliates and subsidiaries makes any guarantee as to if, how, or when any submitted information and data may or may not be acted upon by law enforcement or first responders.

If your mobile device uses Global Positioning System (GPS) technology, trackers, or other location tracking tools, your location information may be used for purposes of determining your location when using a function on the Visual 911+ App, and/or the Disaster ID+3 App that uses such information. While using the Service, if you allow your location information to be obtained, it will be used solely to determine your estimated location. The Company does not monitor your GPS tracking or location information, and does not save this information.

By using the Visual 911+ App, Disaster ID App, and/or Disaster ID+3 App you expressly agree and acknowledge that the Company shall not responsible for any of the following: (a) performance limitations and/or failures experienced in connection with any wireless or Wi-Fi service used to access the applications; (b) data transmitted through wireless access that may be intercepted by unauthorized persons; or (3) your failure to physically secure and/or monitor your wireless device or to protect your passwords, resulting in unauthorized access to your device and/or your personal information.

While using any web-enabled mobile or handheld device to use the Visual 911+ App, Disaster ID App and Disaster ID+3 App, standard mobile phone carrier and data usage charges will apply. You expressly agree and acknowledge that the use of any mobile or handheld device is at your sole risk and shall be in accordance with all applicable local, state and federal laws.

The Visual 911+ app, Disaster ID app, and Disaster ID+3 app collects current location, current user name, user phone number, and email addresses entered as lifelines by the user.

We do not use any saved information for any purposes other than the apps proper functioning.

We do not share any collected information with 3rd parties. Name, location information, and phone number will be shared with the lifelines through email in case the app is utilized to send an alert. If the users of the Visual 911+ app and Disaster ID+3 utilize the tweet feature the name, phone number, location, and alert status message will be shared with the users Twitter followers and/or any viewers of a particular hashtag that was entered prior to sending the tweet.

Southwest Synergistic Solutions reserves the right, at any time and without prior notice, to modify or replace any of the Policy. Any changes to the Policy can be found at App Policy or App Privacy Policy . It is your responsibility to check the Policy periodically for changes. Your use of the Services following the posting of any changes to the Policy constitutes acceptance of those changes.

The US Government, HHS, and ASPR do not endorse, approve, recommend, or collaborate in this work.

Any misuse or abuse of the Visual 911+ App, Disaster ID app, and/or Disaster ID+3 App is strictly prohibited.

MAKING A FALSE REPORT TO LAW ENFORCEMENT IS A SERIOUS CRIME AND MAY BE PUNISHABLE BY LAW.
